Lenders claim that these fees cover the cost of the extra work involved with accounts that fall into arrears. The FSA has ruled that these charges need to be fair and reflect accurately the extra work involved. Kensington Mortgages, which specialises in mortgages to customers with patchy credit records, has been fined £1.2m by the Financial Services Authority for levying unfair charges on borrowers in arrears.
Kensington is the second mortgage lender to be fined by the FSA over its arrears handling. Another specialist lender GMAC-RFC was fined £2.8m - the biggest mortgage-related fine ever imposed by the FSA - and ordered to reimburse more than 46,000 customers up to £7.7m.
An FSA spokeswoman confirmed six mortgage lenders still remain under investigation following a recent review on how specialist lenders and third party administrators were handling mortgage arrears and repossessions
